1. Acceptance of Terms

The Agentic Index is operated by Agentic Digital LLC (“we,” “us,” or “The Agentic Index”) from Florida, United States.
2. Use of the Site
You may use this site for lawful purposes only. You agree not to:
- Use the site to transmit spam, malware, or harmful content
- Attempt to access systems or data not intended for public access
- Misrepresent your identity, credentials, or business when submitting a listing application or contact form
- Use automated tools to scrape or extract content from this site without written permission
- Use this site in any way that could damage, disable, or impair its operation
3. Affiliate Links and Tool Recommendations

4. Provider Listings — Terms for Listed Consultants
AI consultants who apply for and pay for a listing (“Providers”) agree to the following:
- Accuracy: All information submitted in your listing application must be accurate and truthful. You are solely responsible for the content of your listing. We reserve the right to remove any listing we determine contains false or misleading information.
- Credentials: We do not verify credentials, licenses, certifications, or insurance. You represent that you hold any credentials claimed in your listing and that you comply with all applicable laws in your jurisdiction.
- Conduct: You agree to respond to client inquiries professionally and in good faith. Repeated complaints from users about a listed provider may result in listing removal without refund.
- Content ownership: You retain ownership of information you submit. By submitting, you grant us a non-exclusive license to display your information on this site for the duration of your listing.
5. Listing Fees, Cancellation, and Refunds
Fees: Listing fees are charged monthly in advance at the rate applicable to your selected plan at the time of signup. Rates are subject to change with 30 days notice.
Cancellation: You may cancel your listing at any time by emailing hello@theagenticaiindex.com. Cancellation takes effect at the end of the current billing period. You will retain your listing until that date.
Refunds: We do not offer refunds for partial months or for listing periods already paid. If you cancel mid-month, your listing remains active until the end of the period you paid for. No partial refunds will be issued.
Exception: If we remove your listing due to our error or a change in our service offering, we will refund a prorated portion of your current month’s fee.
Non-payment: If a listing fee payment fails and is not resolved within 7 days, your listing will be suspended until payment is received.
6. Intermediary Role — No Liability for Provider Services
The Agentic Index is a directory and intermediary. We connect trade business owners with AI consultants. We are not a party to any agreement between a site visitor and a listed provider. We do not supervise, endorse, or guarantee the quality of services provided by any listed consultant.
We are not liable for:
- The quality, outcome, or fitness of any services provided by listed consultants
- Disputes between visitors and providers
- Any loss, damage, or harm arising from engaging a listed provider
- The accuracy of self-reported information in provider listings
Always conduct your own due diligence before engaging any service provider. Verify credentials, request references, and review contracts carefully before paying any provider.
7. Content and Intellectual Property
All content on this site — including text, design, trade page content, and tool descriptions — is owned by The Agentic Index unless otherwise noted. You may not reproduce, republish, or redistribute our content without written permission.

Our total liability to you for any claim arising from use of this site shall not exceed the amount you paid us in the 12 months prior to the claim, or $100 if you paid nothing.
10. Indemnification
You agree to indemnify, defend, and hold harmless The Agentic Index, Agentic Digital LLC, and its members from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or in any way connected with: (a) your use of the Site, (b) any listing information you submit, or (c) your interactions or agreements with any listed AI consultant.
11. Binding Arbitration and Class Action Waiver
⚖️ Arbitration Notice: This agreement contains a binding arbitration provision which may be enforced by the parties.
Before initiating any formal legal proceeding, both parties agree to attempt to resolve any dispute informally through good-faith negotiation. If you have a dispute with us, contact us first at hello@theagenticaiindex.com with a written description of the dispute and the resolution you seek. We will try to respond within 10 business days. The parties agree to negotiate in good faith for a period of 30 days from the date the dispute is first raised in writing before either party may initiate arbitration.
(a) Agreement to Arbitrate
Any dispute, claim, or controversy arising out of or relating to these Terms of Service, your use of the Site, any listing you submit or purchase, any interaction with a listed AI consultant, or the breach, termination, enforcement, interpretation, or validity of these Terms (a “Dispute”) shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (“AAA”) under its then-current Commercial Arbitration Rules (or Consumer Arbitration Rules if you qualify as a consumer), except as modified below. This agreement to arbitrate is mutual and applies to both you and The Agentic Index.
(b) Exceptions
You (or we) may bring an individual claim in small claims court in Pasco County, Florida, if the claim qualifies and remains there. Either party may seek temporary or preliminary injunctive relief in a Florida court solely to protect intellectual property rights or enforce confidentiality obligations.
(c) Procedure and Venue
The seat of arbitration shall be Pasco County, Florida (or another Florida location mutually agreed). The arbitrator shall apply the Federal Arbitration Act and the substantive laws of the State of Florida. The arbitrator’s decision shall be final and binding, and judgment may be entered in any court having jurisdiction.
(d) Costs and Fees
Each party shall bear its own costs and attorney fees, unless the arbitrator determines a claim was brought in bad faith, in which case the arbitrator may award fees and costs to the prevailing party. The Agentic Index will pay any AAA filing or administrative fees exceeding what you would pay to file the same claim in small claims court, up to the applicable AAA filing fee schedule for claims of equivalent size, provided you follow AAA procedures.
(e) Class Action Waiver
All disputes shall be resolved on an individual basis only. You and The Agentic Index waive any right to bring, join, or participate in any class action, collective action, representative action, or consolidated proceeding (in arbitration or court). The arbitrator may not consolidate claims or preside over any class or representative proceeding.
(f) Delegation
The arbitrator, and not any court, shall decide any dispute regarding the enforceability, scope, or validity of this arbitration agreement (including the class action waiver).
(g) Survival
This arbitration agreement survives termination of these Terms or your use of the Site.
12. Governing Law
These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Pasco County, Florida.
13. Force Majeure
The Agentic Index shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, internet or hosting outages, third-party platform failures, government actions, or other circumstances outside our reasonable control. In such events we will make reasonable efforts to restore service as quickly as practicable.
14. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms of Service, together with our Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and The Agentic Index regarding your use of this Site and supersede any prior or contemporaneous agreements, communications, or understandings, whether written or oral, relating to the subject matter herein.
16. Changes to These Terms
We may update these terms at any time. We will post the updated terms on this page with a new review date. Continued use of the site or continued listing after updated terms are posted constitutes acceptance of the new terms. For material changes we will notify active listed providers by email at least 14 days before the changes take effect.
